President Bidya Devi Bhandari’s decision to dissolve the House on Prime Minister KP Sharma Oli’s proposal was illegal, according to a five-member constitutional bench led by Chief Justice Cholendra Shumsher Rana.
This is the second occasion under PM Oli’s tenure that the Apex Court has ruled in favor of House restoration.
The constitutional bench has decided to hear the allegations of the writ case filed by Nepali Congress President Sher Bahadur Deuba, in an extraordinary decision.
In the same judgment that legitimized Deuba’s claim, the Constitutional Bench issued a mandamus ordering Deuba to be appointed Prime Minister within two days. Similarly, an order has been granted for the House to be reinstated within seven days.
